This website is operated by AuPaw Ltd. Throughout the site, the terms “we”, “us” and “our” refer to AuPaw Ltd. AuPaw Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, cancellations, media release and notices stated below.

By visiting our site and/or booking and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website.

 

It is your responsibility to check this page periodically for changes. Your continued use of or access to the website

following the posting of any changes constitutes acceptance of those changes.

1. General

​

1.1 This agreement is between Client/Pet Owner and AuPaw Ltd. Client/Pet Owner desires to engage with AuPaw Ltd

and its contractors to provide pet care and agrees to the terms and conditions below.

​

1.2 Client/Pet Owner electronically signs this Agreement when they access our Client/Pet Owner portal and engage our services. Client/Pet Owner shall be deemed to have accepted these terms and conditions by electronically signing this Agreement when becoming a member of our Client/Pet Owner portal.

​

1.3 AuPaw Ltd may vary these terms and conditions at any time. In this case the Client/Pet Owner will be notified

and asked to accept the new Agreement. Refusal to accept the new terms and conditions will result in termination of service and profile.

​

2. Bookings

​

2.1 In order to secure a booking, Client/Pet Owner must agree to the company policies. Failure to adhere to our company policies may result in future bookings or service requests being cancelled or declined.

 

2.2 AuPaw Ltd does NOT accept bookings to share pet visits and/or duties with any other parties (e.g. neighbours,

friends, family members etc).

​

2.3 If you are returning home earlier than planned or need to extend your booking unexpectedly, please contact

AuPaw Ltd as soon as possible to advise the change and discuss our availability.

​

3. Rates

​

3.1 Client/Pet Owner acknowledge current AuPaw Ltd rates at the time of booking the service.

 

3.2 Prices for our services are subject to change without notice. AuPaw Ltd reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

 

4. Holiday fees

 

A 20% surcharge per visit is applied for all services that fall on a public holiday.

5. Payment:

​

5.1 All bookings require a 50% deposit if made prior to the full payment 7 day policy.

​

5.2 All bookings MUST be paid in full 7 days prior to a booking commencing. This will be charged to your chosen

card provided at the time of booking.

​

5.3 All bookings are sent a reminder 24 hrs prior to your chosen email.

​

5.4 Any bookings that have not been paid 6 days from the booking date and no contact having been made will

have their booking cancelled.

​

6. Cancellation Policy:

​

We understand that plans may change. Once we have scheduled and confirmed your booking, a fee may apply

for any short notice cancellations. This compensates us for time set aside for your booking that another Client/Pet Owner may have been turned away from. By booking with us, Client/Pet Owner agrees to the AuPaw Ltd cancellation policy which is as follows:

6.1 Full Booking Cancellation

​

6.1.1 Cancellations are accepted up to 3 days prior to your booking dates. A full refund will be carried out.

6.1.2 Cancellations made 2 days prior to your booking dates will not be accepted. No refunds or credits

will be made.

​

6.2 Partial Booking Cancellation

​

6.2.1 In the event that Client/Pet Owner returns home earlier than expected, no refund will be made.

​

6.2.2 In the event that Client/Pet Owner departing later than the reservation when a booking is due to commence, no refunds will be made. Please notify AuPaw Ltd if you choose to leave later/the following day and need to cancel the initial visit/s of your booking.

​

7. Supplies & Restocking supplies

​

7.1 Client/Pet Owner agree to provide all supplies/access to needed for the care of the pet/s, including but not limited to pet food, water, cat litters, cleaning supplies, plastic bags, and any medications required. If the sitter needs to restock supplies that the Client/Pet Owner had agreed to provide but that are not provided at the time of the service (such as pet food or medication)

7.2 AuPaw Ltd is authorized to the purchase of necessary supplies for the satisfactory performance of duties.

​

7.3 An invoice of the purchases will be provided. Client/Pet Owner agrees to pay AuPaw Ltd a $60/restocking fee

and reimbursement of all costs/invoice/s from the purchases within seven (7) days. Overdue accounts will be forwarded to our Debt Collection Agency, and further charges will be levied in respect of costs incurred in collecting the debt.

 

8. Pet Illness / Veterinary Care / Medical Emergency

​

8.1 If any medical emergency are identified, AuPaw Ltd will first make reasonable attempts to contact:

• Client/Pet Owner (a minimum of 2x)

And then

• Emergency Contact (a minimum of 2x)

If both the Client/Pet Owner and Emergency Contact cannot be contacted for whatever reason, we will contact your veterinarian (or an after-hours should they be closed) and follow their professional guidance and make an appointment with your regular veterinary clinic if required.

​

8.2 Should your regular veterinary clinic be closed or there be no appointments available, an appointment will be

made either with another local veterinary clinic or an after-hours clinic.

​

8.3 In the unlikely case your pet requires emergency attention, Client/Pet Owner agrees to authorise AuPaw Ltd to take the pet/s to a veterinary hospital for treatments. Client/Pet Owner agrees to pay AuPaw Ltd the sum of $55/per hour should the sitter need to take the pet/s to a vet.

​

8.4 Client/Pet Owner is aware and agrees to the medical costs of any fees should they arise from animal/s being

ill or otherwise needing veterinary care. Client/Pet Owner agrees to take full financial responsibility for all veterinarian expenses. Client/Pet Owner agrees to reimburse AuPaw Ltd all costs/invoice/s incurred from any treatments for the pet within (7) days. Overdue accounts will be forwarded to our Debt Collection Agency, and further charges will be levied in respect of costs incurred in collecting the debt.

 

9. Injury to Client/Pet Owner animal/s by another animal:

​

AuPaw Ltd and its contractors will not be responsible for any animal/s that instigate fights with other animals or

is injured by another animal while in AuPaw Ltd care. We will take all appropriate actions to ensure that Client/Pet Owner’s animal/s are not placed in the company of aggressive or violent animals and/or will immediately remove Client/Pet Owner’s animal/s from any animal fight.

​

10. Injury or escape of animals:

​

Client/Pet Owner and sitter are aware that the highest level of care shall be given to any and all pets under care

of the individual contracted by AuPaw Ltd. Client/Pet Owner is aware that pet/s are instinctual in nature and not

always controllable by the contractor even when the highest level of care is provided. Should the Client/Pet Owner’s animal/s run away or be injured, the Client/Pet Owner agrees that AuPaw Ltd will not be responsible for any liability. The  above waiver of liability in favour of AuPaw Ltd shall not apply or be effective if AuPaw Ltd conduct in providing its pet care services is found to be grossly negligent, reckless, or if there is intentional misconduct.

​

11. Injury to Pet Sitter or another person by Client/Pet Owner’s Animal/s:

​

Client/Pet Owner will be responsible for all medical expenses and damages resulting from an injury to contractor

or other person/s by the Client/Pet Owner’s pet/s. Client/Pet Owner agrees to pay the full cost of any and all medical expenses and damages should they arise to the AuPaw Ltd contractor or their possessions as a result of the Client/Pet Owner’s animal/s actions. Client/Pet Owner agrees to identify, hold harmless, and defend AuPaw Ltd in the event of a claim by any person injured by the Client/Pet Owner’s pet/s.

​

12. Unsafe Pet/s:

​

This contract permits AuPaw Ltd to use discretion to stop and end service/s at any time that Client/Pet Owner’s

pet/s pose a danger to the safety and health of itself, other pets, other people or AuPaw Ltd contractors.

 

13. On-leash only:

​

Some of our Client/Pet Owner request off-leash activity and play for their dog/s.

​

AuPaw Ltd is strictly on leash only. Hobsonville is an on-leash only area. At the discretion of the AuPaw Ltd contractor and only in designated areas in order to provide maximum exercise and play for Client/Pet Owner’s dog/s may they use a long lead re-call method.

​

14. Solicitation of AuPaw Ltd Contracted Pet Sitters / Dog Walkers:

​

Client/Pet Owner agrees that the contractor provided by AuPaw Ltd is contracted through AuPaw Ltd and is contracted to work only through AuPaw Ltd and not directly through the individual Client/Pet Owner. Client/Pet Owner agrees that all bookings for present and future must be made through AuPaw Ltd and not the individual.

 

Client/Pet Owner is aware that the AuPaw Ltd contracted sitter may give out his/her personal number to the Client/Pet Owner. Client/Pet Owner agrees to use this number only in the event of an emergency during which the contractor is already contracted directly through AuPaw Ltd for Client/Pet Owner. Client/Pet Owner agrees that this number shall not be used for any solicitation of future services. Client/Pet Owner is aware that should this contract be broken, legal fees and misuse-of-staff charges will apply.

15. Photos & Videos

 

Client/Pet Owner authorise the use of the pet/s photos & videos on social medias, website, and marketing materials, for promotional purposes. AuPaw Ltd will ensure photos using personal belongings, bedrooms, mirrors (unintentional reflection), windows (unintentional reflection), or address identifiable images will not be used. If you do not wish for any of your pet/s images to be used, please let us know via email sniff@AuPaw.co.nz

16. Access

​

16.1 Please either provide 2 methods of access e.g. Code & key or upon providing a code have a physical backup with your emergency contact (if local) or a neighbour. If primary access method doesn’t work or fails, the secondary method is used to gain immediate entry and ensure pets are taken care of. No booking will be accepted without a confirmed backup option. AuPaw Ltd priority is to the welfare of your pet/s.

 

16.2 Client/Pet Owner give AuPaw Ltd and/or its contractor authority to commission the service of a locksmith at

the cost of the Client/Pet Owner should the lock malfunction or fail for any reason. All fees for the locksmith will

be paid by Client/Pet Owner or fully reimbursed to AuPaw Ltd within seven (7) days from the incident. Overdue

accounts will be forwarded to our Debt Collection Agency, and further charges will be levied in respect of costs

incurred in collecting the debt. AuPaw Ltd priority is to the welfare of your pet/s.

​

16.3 AuPaw Ltd can hold house keys and/ or garage remotes for the convenience of Client/Pet Owner. The keys

and/or garage remotes will not be tagged with any home address and will be kept securely.

​

17. Client/Pet Owner Home Security & Care:

​

17.1 AuPaw Ltd will NOT accept liability if others (friends, family members, workers etc…) are allowed entry to the

home over the course of service.

​

17.2 Client/Pet Owner MUST notify AuPaw Ltd if anyone else will have access to your home during the course of

our service. This is to ensure the safety of our contractor whilst at your home. It would be appreciated if you, the

Client/Pet Owner, would also notify the person/s with access to the home that AuPaw Ltd will be caring for your

Pet/s during your absence.

​

17.3 AuPaw Ltd will not allow entry to any person who have not been made aware of in advance. The police will be called on any intruders or suspicious acts without exception.

​

17.4 AuPaw Ltd is not liable for any loss or damage in the event of a burglary or other crime that should occur

while under this contract. Client/Pet Owner agrees to secure home prior to leaving the premises.

​

17.5 AuPaw Ltd will re-secure the home according to Client/Pet Owner/s instructions at the end of each visit. While AuPaw Ltd will take all reasonable care to enter and leave the property in a safe and responsible manner, ensuring any doors or gates used to access the home are secure on leaving, AuPaw Ltd accepts no liability for any breach of security, loss of, or damage to, the Client/Pet Owner home by a third party.

 

17.6 AuPaw Ltd is not responsible for any damage to the property or home of the Client/Pet Owner unless such damage is caused by the negligent act of AuPaw Ltd.

​

17.7 AuPaw Ltd is not responsible for damage to the home beyond the control of the contractor. This includes, but is not limited to: door lock damages, broken windows, electrical problems, leaks, and acts of nature. All repairs to home and related fees will be paid by Client/Pet Owner or fully reimbursed to AuPaw Ltd within seven (7) days from the incident. Overdue accounts will be forwarded to our Debt Collection Agency, and further charges will be levied in respect of costs incurred in collecting the debt.

 

17.8 AuPaw Ltd is not responsible for wilted, dead or otherwise unhealthy plants. AuPaw Ltd contractors will work hard to follow written instructions as precisely as possible, but cannot be responsible if the results are not favourable to the Client/Pet Owner. Please place all indoor plants together on a waterproof surface in plain sight as your pet sitter is not responsible for water-damaged areas or missed plants.

​

17.9 Client/Pet Owner is responsible for pet-proofing house and yard and security fences/gates/latches. AuPaw Ltd will not be responsible for the safety of the pet/s and will not be liable for the death, injury, disappearance or legal consequences of any pet/s with unsupervised access to the outdoors.

​

18. Extreme Weather or Natural Disasters

​

18.1 In the event of inclement weather, natural disaster or circumstances beyond our control, e.g. acts of terrorism, lightning storms, blizzards, earthquakes etc. AuPaw Ltd and its contractors are entrusted to use best judgment in caring for pet/s and their home. AuPaw Ltd will be held harmless for consequences related to such decisions.

18.2 In the event that should we be unable to reach Client/Pet Owner home due to weather conditions or in the case of a natural disaster, AuPaw Ltd will contact you by phone to let you know of the situation. We will then work together with your emergency contacts to ensure your Pets receive adequate care.

​

19. Termination of Service

​

AuPaw Ltd reserves the right to deny or terminate service/s because of safety concerns, financial issues, failure to

comply with policy, inappropriate behaviour or uncomfortable circumstances.

​

20. Change of Terms

 

Policies and procedures are subject to reasonable changes and amendments, which may be implemented from

time to time.
